Terms of Service

1. Agreement and operator

These Terms govern Orbit, a multi-platform short-form video publishing service operated by Marco Pérsico, CUIT 20-38644923-7, of 12 de Octubre 3015, Córdoba, Argentina ("Orbit", "we", "us"). By creating an account or using Orbit, you agree to these Terms and the Privacy Policy.

2. Eligibility and territory

You must be at least 13 years old and able to enter into a binding agreement. If you are under the age of majority where you live, you must have permission from a parent or legal guardian. If you use Orbit for an organization, you confirm that you have authority to accept these Terms for it.

Orbit is currently intended for users in Argentina, Brazil and other Latin American countries. It is not intentionally offered or directed to people in the European Economic Area or the United Kingdom.

3. Accounts and connected platforms

You are responsible for activity under your Orbit account and for keeping access to your sign-in provider and connected platforms secure. You may connect only accounts that you own or are authorized to manage.

Orbit acts only on the authorizations you grant. You may disconnect a platform in Orbit or revoke access through that platform. Platform APIs, terms, privacy policies and community rules continue to apply and may cause a post to be delayed, changed or rejected.

4. Your content

You retain ownership of your videos and publishing metadata. You grant us a limited, non-exclusive, worldwide permission to temporarily store, process, transmit and publish that content only to operate Orbit and complete the destinations you select.

You represent that you have all rights, permissions and lawful bases needed for your content, including rights in music, images, trademarks, copyrighted works and personal data. Orbit is not permanent cloud storage; keep your own copy of every video.

5. Acceptable use and intellectual property

You must follow our Acceptable Use Policy, which forms part of these Terms. You must not use Orbit for unlawful, harmful, deceptive, abusive, infringing or unauthorized activity.

Orbit and its licensors own the service, software, branding, visual design and documentation. These Terms grant you only the limited right to use Orbit in accordance with them. Copyright notices are handled under our Copyright Policy.

6. Service availability and current pricing

Orbit depends on infrastructure providers, third-party APIs and the internet. We work to operate the service reliably, but publication and availability are not guaranteed.

Orbit is currently offered without a paid subscription or purchase flow. These Terms do not create a commitment to provide any future paid plan, feature, price, trial or refund policy. If paid services are introduced, we will provide the applicable terms before charging you.

7. Suspension and termination

We may suspend or terminate access, disconnect a provider, cancel a pending upload or remove content from Orbit when reasonably necessary to protect the service, users or third parties, or for a violation of these Terms, platform rules or law. You can request account deletion as explained in Data Deletion.

8. Disclaimers and liability

To the maximum extent permitted by law, Orbit is provided "as is" and "as available" without warranties of uninterrupted availability, merchantability, fitness for a particular purpose or non-infringement. Nothing in these Terms excludes rights that cannot lawfully be excluded.

To the maximum extent permitted by law, Orbit and its affiliates are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or lost profits, revenue, data, goodwill or content. Our total liability for a claim related to Orbit will not exceed the amount you paid to Orbit in the 12 months before the event giving rise to the claim. This limitation does not apply where the law prohibits it.

9. Governing law and venue

These Terms are governed by the laws of the Argentine Republic. The ordinary courts of the City of Córdoba, Argentina have jurisdiction over disputes arising from these Terms, except where mandatory consumer-protection or other applicable law gives you a different right or forum.

10. Changes and contact

We may update these Terms when Orbit or applicable law changes. We will post the revised version here and update the date above. Your continued use after the effective date means you accept the revised Terms to the extent permitted by law.
